Compensatory award

A sum of money made up of two parts: a basic award and a compensatory award.

The basic award is calculated along similar lines to that in redundancy – according to years' service times weekly pay subject to a maximum and minimum for the basic award. The amount of the compensatory award is discretionary according to what the tribunal consider to be 'just and equitable in all the circumstances'.

 

The amount of compensatory award is calculated according to discrimination claims, where health and safety rights have had to be made an issue and 'whistle blowing' in the public interest under the Public Interest Disclosure Act 1998.
