Equitable remedies

Equitable remedies are discretionary. They are only awarded at the discretion of the court.

An equitable remedy refers to an award made at the discretion of the court and makes the defendant perform his part of the contract.

This is instead of imposing a fine on the defendant for breach of contract.

This step is taken if the court is of the opinion that payment of damages is not sufficient to settle the case.
