An employer must give notice of the termination of an employee's employment.

 

This term applies to the termination by the employer of the employee's employment.

 

An employer must give notice of the termination of an employee's employment. The notice will stipulate when the contract of employment will come to an end – the period of notice to be given will be stipulated in the contract. These may be more generous than the statutory minimum notice periods and care should be taken so as to comply with the contractual requirements.

 

The minimum statutory periods are prescribed according to the length of service carried out by the employee. The greater the service – the longer the period of notice that must be given. The employee is entitled to whichever period of notice is greater - either under the statutory provision or the contract.

 

In some cases it may not be appropriate for the contract of employment to continue regardless of the entitlement to notice for example where summary dismissal is justified or where the employee accepts a payment in lieu of notice.
