Nudum pactum

A bare, naked contract which has no consideration.

Nudum Pactum is derived from the Latin and in the literal sense means 'Bare or Naked Promise.'

It refers to an agreement which is made without consideration and, with some exceptions, is void. Sealed agreements, bills of exchange and promissory notes are exceptions and are usually good despite there being no consideration.

A nudum pactum is not binding and no action can be maintained on a naked agreement whether it is verbal or written.
