Per stirpes

This is a term that can arise when a beneficiary predeceases a testator or a testatrix.

To overcome any unfairness that might arise when a beneficiary predeceases a testator or a testatrix, should a gift fail, it is usual for practitioners to recommend an alternative gift to the children of the beneficiary to the effect that the gift is divided equally between the children or 'per stirpes'.
