Unregistered land

Land which is not registered at hm land registry.

Unregistered land means that reliance must be made upon the previous system of establishing ownership of land. This required the production of a bundle of legal deeds and documents that proved that the person concerned was indeed the legal owner of the property.  

This produced problems from time to time, for example, deeds could be lost or destroyed which could result in costly delays when it came to selling the property. 

These documents were complex and very lengthy which in turn added to costs as these needed to be checked each and every time the property was sold or mortgaged.

The policy is to work towards the registration of all land eventually at HM Land Registry.  This process began as long ago as 1925 and was introduced by the Law of Property Act 1925.
